Charlotte Pipe vs. Chinese Shell Companies

124 years in business. 2,800 American workers. 10 out of 10 legal victories. $44.5 million in evaded duties. Still no relief.

"The AD/CVD process is broken and in need of far stronger remedies. The costs to file and win these cases are exceedingly high and the promise of relief has become non-existent."

— Bradford Muller, VP Corporate Communications, Charlotte Pipe and Foundry, House Judiciary Testimony, July 22, 2025

The Enforcement Paradox

Charlotte Pipe has won every single legal case—10 out of 10 EAPA investigations, unanimous ITC votes, dumping margins up to 494%. Yet Chinese shell companies have evaded $44.5 million in duties, and total foreign cast iron tonnage actually increased after duties were imposed.

Phase 1

The Legal Victories

2017
AD/CVD Petitions Filed

Charlotte Pipe, through the Cast Iron Soil Pipe Institute (CISPI), files AD/CVD petitions against Chinese imports of cast iron soil pipe and fittings.

August 2018
Charlotte Pipe Wins Cast Iron Fittings Case

ITC votes unanimously in Charlotte Pipe’s favor. Commerce determines Chinese dumping margins of 41–494% on fittings. Duties imposed immediately.

March 2019
Charlotte Pipe Wins Cast Iron Soil Pipe Case

ITC again votes unanimously for Charlotte Pipe. Commerce determines Chinese dumping margins of 250–345% on soil pipe. Both orders now in force.

Phase 2

The Shell Game

As Chinese exports of cast iron pipe dropped, Cambodian and Malaysian exports surged in direct correlation. Cambodia has no foundries that make cast iron pipe.

March 2020
First EAPA Victories — Cambodia

CBP finds Lino Metals and Blue Star Casting guilty of transshipping Chinese cast iron through Cambodia to evade Charlotte Pipe’s AD/CVD orders.

July 2021
Phoenix Metal — The Cycle Exposed

Little Fireflies and Phoenix Metal found guilty of evading Charlotte Pipe’s orders. Phoenix Metal’s own lawyers admitted it was created by the same people behind HiCreek after HiCreek got caught. When Phoenix lost its appeal, it dissolved rather than pay duties.

October 2022
Evasion Shifts to Malaysia

LDL Trading and Vanguard Metal found guilty of transshipping cast iron through Malaysia to evade Charlotte Pipe’s orders. New country, new shell companies, same Chinese product.

April 2023
Charlotte Pipe’s 10th Consecutive EAPA Win

Besttn Industry and United Metal found guilty. Charlotte Pipe reaches a perfect 10-for-10 EAPA record—yet total foreign cast iron tonnage has actually increased since duties were imposed.

Phase 3

The Resilience

Charlotte Pipe reinvests in American manufacturing despite the enforcement failure.

2023
Charlotte Pipe Closes Its Historic Charlotte Foundry

After more than 100 years of continuous operation, Charlotte Pipe closes its original foundry on the outskirts of Uptown Charlotte and relocates cast iron production to a new $460 million, 500,000-square-foot facility in Oakboro, NC—35 miles east. Approximately 530 workers now operate the new foundry.

2024
Sunset Reviews — Orders Renewed Unanimously

ITC unanimously renewed both of Charlotte Pipe’s AD/CVD orders on cast iron soil pipe and fittings from China. No importers even appealed—why pay trade lawyers to contest orders you can simply evade?

March 12, 2026
Charlotte Pipe Absorbs Neenah Foundry Into Infrastructure Division

Charlotte Pipe formally aligns Neenah Foundry, US Foundry, and Bingham & Taylor under a unified Infrastructure Division. Neenah’s facilities in Wisconsin and Florida continue operating alongside Charlotte Pipe’s 8 plants and the new Oakboro foundry.

Phase 4

The Congressional Fight

July 22, 2025
Charlotte Pipe Testifies Before House Judiciary

VP Bradford Muller testifies before the Subcommittee on Courts, IP, AI, and the Internet in a hearing titled “Foreign Abuse of U.S. Courts.” Muller presents evidence of Chinese brokers openly advertising evasion services—including email solicitations and TikTok videos promising to “beat U.S. tariffs”—and calls for passage of the Fighting Trade Cheats Act and the PAIL Act.

February 13, 2026
Fighting Trade Cheats Act Reintroduced in Senate

Senators Katie Britt (R-AL) and Tammy Baldwin (D-WI), joined by Thom Tillis (R-NC) and John Fetterman (D-PA), reintroduce the FTCA. The bill would triple penalties for customs fraud, impose 5-year bans on fraudulent importers, and create a private right of action allowing companies like Charlotte Pipe to seek injunctive relief and treble damages.

Current Status
FTCA Awaiting Action — Shell Companies Still Evading

Despite bipartisan Senate and House support, neither the FTCA nor the PAIL Act has been enacted. Shell companies continue to dissolve when caught and reconstitute under new names to continue evading Charlotte Pipe’s hard-won AD/CVD orders.

The Harsh Reality

Chinese producers brazenly shut down sham shell companies and create others to avoid paying duties... these entities have no intention of ever paying the duties.

— Bradford Muller, Charlotte Pipe and Foundry, House Judiciary Testimony

Short of the remedies provided in the FTCA and PAIL Act, industries will be very reluctant to undertake AD/CVD cases in the future.

10 Legal Victories. $44.5M Evaded. Zero Relief.

When perfect legal victories produce nothing, the system is broken. Tell Congress to pass the FTCA and the PAIL Act.

Charlotte Pipe won every case. They still lost.

When perfect legal victories produce zero relief, the system is broken. Demand enforcement that matches the law.
